1. Giveaway Description. The Futurist Product Officer (“FPO”) Survey giveaway (“Giveaway”) is an online giveaway for those FPOs who complete the survey (“Participant” or “You”) via the link provided by Future Faraday (“FF”).
2. Eligibility. The Giveaway is open to FPOs who are legal residents of California and who have completed the FPO survey pursuant to the terms and conditions set forth herein. Entrants must be 18 years or older as of the date the survey is completed in order to qualify. This Giveaway is subject to federal, state, and local laws and regulations and void where prohibited by law. The Giveaway is not open to employees of Faraday Future or their immediate family members or members of their households. Survey must be completed by 11:59 PM Pacific Time on Tuesday, December 7, 2021, to be eligible for entry. Entries are open to all individual users who are FPOs. The Sponsor reserves the right, in its sole discretion, to disqualify any entry that includes a submission or supporting statement that does not meet the submission requirements and restrictions. Entries are limited to one survey response per person.
3. Sponsor. Faraday Future, 18455 S. Figueroa St., Los Angeles, CA 90248.
4. How to enter. No purchase or payment is required to play or win the Giveaway. To enter to our Giveaway, FPOs must complete the FPO survey in its entirety. Surveys must be completed by 11:59 PM Pacific Time on Tuesday, December 7, 2021, to be eligible for entry.
5. Giveaway period. The Giveaway entry period begins on November 30, 2021. The survey must be completed by 11:59 PM Pacific Time on December 7, 2021 to enter the Giveaway. Two FPO users who complete the survey within the applicable time period will be eligible to win a Prize, subject to compliance with these Official Rules. The two winners will be announced on December 8, 2021 via e-mail. Each winner will receive an email before 04:00 pm PT on December 8, 2021 and must respond before December 10, 2021 at 5:00 pm PT to claim their prize.
6. Prize. There are two (2) prizes in total. Each prize contains two (2) tickets to the December 12, 2021 Lakers game against the Orlando Magic, valued at an estimated $1,000.00 (“Prize”). No other costs or expenses included in Prize. Unclaimed prizes will be forfeited. All details of Prizes will be determined by Sponsor in its sole and absolute discretion. Sponsor reserves the right to substitute a similar Prize of comparable or greater value for any reason at its sole and absolute discretion. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Prize Winner. Prize cannot be transferred by Prize Winner or redeemed for cash, with no substitution of Prize by Prize Winner.
7. How to win and claim a Prize. FPO survey participants who have completed the survey by 11:59 PM Pacific Time on December 7, 2021 will entered into the drawing pool. Two (2) winners will be chosen by random drawing. Odds of winning a prize are approximately 1 in 160. Each winner will receive an email before 4:00 pm PT of December 8, 2021 and must respond before December 10, 2021 at 5:00 pm PT to claim their Prize. If a Prize is unclaimed, it will be forfeited. Once a Prize is claimed, winners will receive an email with detailed instructions and a verification code for purposes of picking up the tickets in person on December 12, 2021.
8. Agreement to rules and waivers. Participation in the Giveaway constitutes the Participant’s unconditional agreement to comply with and be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding with respect to all aspect of the Giveaway. Winning any prize requires that the potential winner of the prize is, and remains, in compliance with these Official Rules. Until a potential winner is verified to be eligible and in compliance with these Official Rules, the potential winner is, and will remain, a potential prize winner, unless the potential winner is disqualified for not complying with the Official Rules and/or not being eligible to participate in the Giveaway. Sponsor reserves the right to disqualify any potential winner who Sponsor, in its sole discretion, determines is not permitted by law to receive a prize or has not complied with the Official Rules. The Giveaway is further in no way sponsored, promoted, endorsed, associated with, or administered by Los Angeles Lakers.
10. Privacy notice. By participating in the Giveaway, Participants consent to the Sponsor’s use of their personal information submitted or collected in connection with the Giveaway in accordance with and subject to the terms of the Sponsor’s Privacy Policy, available at Privacy Policy | Faraday Future (ff.com) (“Privacy Policy”), which is incorporated by reference as if re-stated in full herein.
11. Winners list. For the names of the Prize Winners, available after December
15, 2021, send a self-addressed, stamped envelope to Faraday Future, 18455 S. Figueroa St., Los Angeles, CA 90248 no later than December 31, 2021.
12. Disclaimer of warranties. The Sponsor makes no warranties, and thereby disclaims any and all warranties, express or implied, concerning any prize in connection with the Giveaway. Without limiting the generality of the foregoing, such prizes are provided “AS IS” without warranty of any kind, either expressed or implied, by the Sponsor.
13. Waiver of liability. By participating in this Giveaway, Participant waives all rights to, and releases and holds Sponsor, and each of its employees, officers, directors, agents, representatives, owners, managers (collectively, “Released Parties”) harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in the Giveaway, the selection of winners, or the acceptance, use, or misuse of any prize. Sponsor will not be responsible for late, incomplete, or incorrect entries; Participants’ failure to receive communications regarding the Giveaway due to the provision of incorrect or non-functioning contact information; technical malfunctions; human error; or any typographical, technological, or other error in the publishing of the offer, administration of the Giveaway, or announcement of the Prizes. Sponsor will not be responsible for any actions, events, or incidents that may occur relating to or arising from the use of any of the Prizes. By entering this Giveaway, Participant further waives section 1542 of the California Civil Code and any similar law of any state, territory, or other jurisdiction. Section 1542 states: A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
14. Dispute resolution. Participant agrees that all matter arising out of or relating to this Giveaway and these Official Rules are governed by, and construed in accordance with, the law of the state of California, United States, without reference to the choice of law principles thereof. As a condition of participating in this Giveaway, except where prohibited by law, Participant agrees that any dispute, claim, or controversy arising out of or relating to the Giveaway, the award of a prize, or the breach, termination, enforcement, interpretation, or validity of the Official Rules, shall be submitted to and determined by JAMS, to be held in Los Angeles County, California, exclusively on an individual, non-class basis pursuant to its Comprehensive Arbitration Rules and Procedures and in accordance with the Expedited Procedures in those Rules. For the avoidance of doubt, Participant agrees that any and all disputes, claims, and causes of action arising out of or related to this Giveaway or any prize awarded shall be resolved individually and not in the form of any class action or other form of representative action. Participant agrees that, as a condition of participating in this Giveaway, Participant waives any right to bring any action arising from or related to the Giveaway or the award of a prize as a class or other representative action.
15. Other conditions. Sponsor assumes no responsibility for computer system, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Giveaway, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control corrupt the administration, security, fairness, integrity or proper play of the sweepstakes. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the sweepstakes by technical or human errors that may occur in the processing of the entries in the sweepstakes. Sponsor reserves the right to withdraw the transmission of this sweepstakes at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web-site or to be acting in violation of the Rules. By participating, all participants signify their agreement to be bound by these Official Rules.
16. Void where prohibited. The Giveaway is void where prohibited. All federal, state, and local laws apply to the Giveaway. Decisions regarding all matters relating to the Giveaway that are not addressed in these Official Rules shall be made by Sponsor in its sole and absolute discretion, and each Participant agrees that all such decisions shall be binding and final. Failure to comply with these Official Rules may result in disqualification from the Giveaway at Sponsors’ sole and absolute discretion. Sponsor reserves the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules.
